Dear Sir,
We are a manufacturer of Finned Tube Heat Exchanger i.e. air cooling Unit. we are registered under Excise.
Most of our customer issued us CT - 2 Certificate for Nil Duty under Notification No.06/2006 dated 01.03.2006 condition No. 2 & 3.
Case Law - Orissa Extrusion / C. C. E. 2000 (115) ELT 30 (SC) & A. P. Paper / C. C. E. 2005 (185) ELT 371 (T)
my question is that whether can we simultaneously avail the input credit & also cleared the goods without payment of duty??

Check rule 6 of the cenvta credit rules.
Possible to avail credit and also cliam the exemption for some clearacnes. stock recording maybe critical.

Sir, You are requested to please explain in detail. Because our excise authorities issue us Show Cause notice for either reverse the input modvat credit or paid excise at connessional rate (Previously it was 10% & Now 5%)
