Notice to dormant company

07 September 2011 My company is dormant it has received notice from ROC towards non filing of B/s and Annual Returns. Further there is Charge is subsisting charge on the assets of the company. The status of the comapny is dormant on mca.gov.in. Please guide me what can i do now? Should i submit a letter in ROC or what should i do?

07 September 2011 If u want to normalize the company, e-file form 61 seeking permission for normalization.
On the other hand, if u want to close down ,try voluntary winding up / Fat Track Exit Mode announced by MCA vide circular which is available in https://www.mca.gov.in/Ministry/pdf/Circular_36-2011_07jun2011.pdf

07 September 2011 thanks for ur suggestion but notice has asked that the Roc will be bolcking the company and in addition to their liability for penal action U/s 168 of the companies CAt. Further has asked for filing all previous annual returns and balance sheet and asked for the present status of the secured loan taken by the company

07 September 2011 Mere reply will not suffice. Either regularize starting with filing of e-form 61 or seek the other alternative as I said earlier.
