Not charged service tax in invoice.

14 January 2012 I have hired a taxi for business purpose but the taxi owner provided the bill for the same service excluding service tax .Is the service tax is to be paid by me or when i can ask for a bill with service tax.Kindly advice & provide the reference if any

14 January 2012 In above case it is the responsibility of taxi operator to collect service tax and deposit the same as per provision of Finance Act, 1994. If he is not doing so then you are not responsible to pay the same.

18 January 2012 Thank you sir,i have one more issue regarding the same :-
what will be the result if the taxi service provider charged the invoice inclusive of service tax, but have not paid the tax portion to the department,though recovered from us.Shall we will be held liable to pay the same or what. Kindly suggest

25 January 2012 In that department will not ask you to deposit service tax. Only taxi owner is responsible for deposit of same. However if you are going to take CENVAT credit in respect of same you should keep proper detail of taxi owner like name, address , service tax number etc.
