One of our client left to USA on 15th march 2017,so on what basis should I determine their residential status for the purpose of Section 195? Should I use the criteria under FEMA or Income Tax Act ?

For determining taxablity under income tax Act same should be determined as per provisions of the income tax act and in other cases FEMA is to be applied
