hello,
can any one tell me - whether agreement to mortgage the property ,does it amounts to creation of mortgage and can such property be considered as secured asset and can a bank proceed against such property under Securitisation Act, 2002.

Mere agreement to mortgage without actually creating mortgage will not tantamount to charge creation.
