18 December 2011 When MCA change company status to Dormant. How many years a pvt company can remain active without filing annual returns.

18 December 2011 All Companies which have not filed their statutory annual filings for both form 20B
and 23AC / 23ACA since 2006 i.e. 2006-2007, 2007-2008 and 2008-2009 (i.e. has not done
any of the six required filings) will not be allowed to file any other e-form with Ministry of Corporate Affairs unless and
until all such pending documents are filed. The status of such companies would be changed to “Dormant".

18 December 2011 A pvt ltd company incorporated in oct. 2006, Form 20B/ 23AC and 23ACA not filed since incorporation. but MCA site showing its status as a active. How it is possible ? After when it will be a Dormant company ?

19 December 2011 Dear Member,

There is no automatic process to make a Company a Dormant one. The ROC office does random check and the Company which are traced are listed as Dormant. Otherwise manier times it happens that a Company has not filed documents for a longer period is left out but others are caught.
