07 October 2011 good afternoon expert
how r u sir ,
i want your help about TDS on refilling chgs for fire extinguisher. we rec. a job work bill of fire extinguisher amt, is 33850. he used his material for refiling . than sir can u plz tell me that in which section i will deduct tds from his amt.

07 October 2011 If the bill is showing the cost of material separately then the amount of job work will be less then rs. 33850/- and you will not needed to deduct tds on the payment.

So try to get a two bills from your supplier one for material charing vat. and another for service charges.

You will not require to deduct tds.

Or get a bill from your supplier only showing charges for material including your service charges + then charge vat on the whole amount No one can ask TDS in that case. Because then it will be a case of purchase of material.

08 October 2011 if cost of material and service charges billed seperately the tds is to be deducted on service charges only not on cost of material. tds have to be deducted under section 194c. but the cost of service charges is below the exempt limit u/s 194c no tds required.
