17 July 2009 Mr. A take work from a company to unload the wheet/rice and cement from railway wagan and load it in lorry. Wagan booked by the company. Lorry freight paid by the company. Weheter this service comes under serice tax? if so under what head?If lorry freight paid by Mr. A - what is the effect? Mr. A is authoried by the railway department for clearing work at railway good shed.

20 July 2009 Thank u sir. If the same assessee enter into an agreement with a CEMENT manufacturer(company) to unload the company vehicle at the companies godown and delivered the cement bags by his lorry to the customers from whom orders taken by the company directely. Assesse raise bill for his unloading of the company vehicle at there godown and loading and freight charges on total basis at Rs. per bag. Whether the assesse raise bill witH service tax?(considered his eisting business in raliway wagon cross 10 lacs PA.)The company needs service tax number before enter into the agreement.
