How to determine the residential status of a partner of LLP under Companies Act 2013/LLP Act and under which section?

residential status is governed by FEMA Act in such cases. LLP Act or companies act don't determine the residential status.

under fema it can be and under income tax act its a partnership firm with limited liabilities.
