Liability to pay service tax

11 January 2013 Dear Expert,
I Abdul Qadir Khan, is a building contractor working with Catholic missionary education society.I want to confirm that the catholic missionary education society is liable to pay service tax on construction of their school buildings.So Please inform me about liability.

13 January 2013 Dear Abdul,

As per the Section 2(7) of Companies Act,1956 the Cooperative Society is not a Body Corporate hence the reverse charge is not applicable in this case.
The entire tax has to be paid by the Service Provider even if you are Individual providing Works Contract Services.
See Notification No.30/2012-ST dated 20-06-2012.
