12 January 2015 Hi all,
My query is suppose a Individual or HUF who is not required to get its accounts audited has made payment to non-resident. whether TDS liability arise on same transaction??? & if yes?? then will TDS liability arise on all subsequent transactions????

12 January 2015 Only for payment to non resident TDS liability arises to individual or HUF irrespective of applicability of tax audit.
For subsequent transactions with residents TDS liability will not arise.

12 January 2015 yes irrespective of applicability of tax audit, tds is applicable u/s 195 for any payments to be made to NRI.

13 January 2015 Thank you Sir,
But what about the TAN no which the firm or individual already taken??? because dept will issue notice for non deduction of TDS. how to deal with such notice??

13 January 2015 A new facility has been started in TDSCPC website to update declaration for non filing of TDS statement for deductors. Deductors can update status of TDS/TCS statement to non-filing online after login at TDSCPC website. The benefit of this facility is that instead of filing nil TDS/TCS return for a particular quarter/period, one just need to update the status to non filing of return. After updation of status, TDSCPC website server will not sent any notice for non filing of TDS return.
