MY RELATIVE HAD GIVEN LOAN BY WAY OF CHEQUE TO ONE PARTY BUT THERE WAS ONLY MUTUAL UNDERSTANDING BETWEEN BOTH OF THEM DUE TO GOOD RELATION. & HENCE THEY WERE NOT ENTERED FOR ANY LEGAL REQUIREMENT. NOW THAT PARTY IS NOT PAYING INTEREST COMPONENT REGULARLY & FOR LOAN REPAYMENT
SO NOW WHAT TO DO CAN MY RELATIVE TAKE ANY LEGAL ACTION AGAINST THAT PARTY
CAN MY RELATIVE ISSUE NOTICE THROUGH HIS LAWYER.
HE HAS PROOF OF DISHHONOUR OF CHQ IN HIS BANK STATEMENT
WHAT WILL BE THE PROCEDURE & LAW
EXPERT ADVICE NEEDED URGENTLY
SO NOW WHAT TO DO CAN MY RELATIVE TAKE ANY LEGAL ACTION AGAINST THAT PARTY

First send a letter for demand of interest and re-call the loan. The same should be sent through Registered A/D. Let him/her reply the same if the neglect then give a layer's notice. and on their further failure file a case in the court. Also file a case u/s 138
