PLEASE LET ME KNOW WHEN A COMPANY LIABLE TO PAY LEAVE PAY TO HIS EMPLOYEES ?

It is not necessary that the co. is a Pvt Ltd or Public Ltd. It depends on the rules of the Company that it Provides Leave salary or not.
PF & ESI does not affect Leave Pay.

i am working in a pvt ltd company from last 3 years but i don't have PF & ESI
can i claim "chutti ki paise" from employer

It is not necessary that u will get the money. Fist inquire that there is any provision for Leave pay in the company. If the answer is yes then only u will receive ur leave pay, otherwise not.
