24 June 2014 I AM LABOR CONTRACTOR AND IN THE YEAR 2011-2012 AND 2012-13 OR 2013-14. THE SUPPLY OF LABOUR TO PRIVATE COMPANY (AS SUB CONTRACTOR) TO THE POWER GENERATING COMPANY.MY QUESTION IS I AM HAVING ANY LIABILITY TO PAY THE SERVICE TAX? PL. REPLY AS SOON AS POSSIBLE.

24 June 2014 If your service is of supplying Manpower

Then it is classified as Manpower Supply Service which is a taxable service under Service Tax

but as per the Notification No 30/2012
if manpower supply is provided to a body corporate (i.e Companies ) then the Liability for service tax is as follows

75% of Service Tax is to be paid by company itself under Partial reverse charge.

25% is to be charged by the Service provider to the company & same must be paid by him to the department.

26 June 2014 IF YOU ARE SUPPLY man power then you you have to charge service tax 12.36% and from 1.7.2012 @ 3.09% and bal. 9.27% payable by the company.

if your bill is over rs. 10 lacs in a year. otherwise not applicable.
