It return to be filed or not for asst year 2014-15

27 June 2014 Sir,

My Brother-in-law was working abroad during the period Aug'2008 till Oct'2013 and he returned back to India for good in Oct'2013.

My query is whether he is required to file Income tax return for accounting year 2013-14 or not.

What is his Residential status for the above mentioned year and accounting year 2014-15.

He falls under the 20% tax bracket.

Also he has some interest income thru nre deposits. What is the tax implication of these?

28 June 2014 filing of return is not based only based on the residential status but also on quantum of income...

so without knowing the details of income earned in India, cannot say whether return needs to be filed or not

Thanks for your reply.

I would not have been asking this question unless the person is having a taxable income. So he has taxable income.

Besides that he also has some Nre deposits . Whether the interest income will also to be included in other income for calculating tax?

29 June 2014 with regards to FY 2013-14:

1. the tax status shall continue to be non-resident

2. Accordingly, interest on NRE deposits shall be exempt from taxation

3. any other income earned in India shall be taxable and return has to be filed.
