Intimation to auditor

If an auditor has been re-appointed in the AGM of a private limited company, but the intimation has been given to the auditors after 3 months . the auditors accepted the appointment on the receipt of intimation . will there be any panelty for late intimation , if yes , what?

The penalty is that, the auditor will pay additional fee for filing of Form-23B with ROC.
The ROC can issue a notice under section 234 to the Company for not intimating ROC with in time.
