08 July 2013 i have filled e form 1A for name availability which requires re-submission due to trademark issue than what should i do if i want to incorporate the company with the same name and when i have checked then there are lost of trademark with the same name and related business.

If the trade mark is available in the proposed name of the company, then if you are the owner of that trade mark then you prove the same, other wise you change the name of your proposed name.


It is not mandatory that propose name should have trade mark.

If you can get noc from the Trade Mark Holder, then you can get the name approval for the same name you applied otherwise you have to change or modify the name of the company.

08 July 2013 If an other company have a trade mark on your proposed name and you are not the promoter/director of that company, then u can not get such proposed name as applied in 1A.
