14 September 2011 If X has one House property self occupied and 2nd H.P which was not let out during the previous year:

1. Is the second property required to be assessed as let out , necesserely.

2. Can he take the plea that since the H.P was vacant it should not be assessed as let out

14 September 2011 At the time of assessment you show for first property as self occupied ALV is NIL and for second property ALV is NIL because not let out during the period but in case any clarification or objection by AO you have to prove the property during the period is not let out.
