18 February 2014 kailash, teacher in a private school having a basic salary 3500 p/m, he claim gratuity from the school management when he resigned from the service of 12 year. will he succeed???

22 February 2014 Teachers do not come under the definition of 'employee' as per the provisions of the Gratuity Act. However, in several States, there are already, separate statutes, rules and regulations granting gratuity benefits to teachers in educational institutions, which are more or less beneficial than the gratuity benefits provided under the Act. So, you must refer to the local legislation. also note that several court judgments have held that teachers are entitled to gratuity.
