is the gratuity recieved by the legal heir of a deceased person taxable?

There are two cases for determining taxability for it.
(1) Gratuity received after the death of a person while in active service is fully exempt from tax.
(2) Gratuity received by the legal heir after retirement of the deceased is taxable under the head” Income from Other Sources”
