Form 15CA (Part C)

25 January 2025 do we need to file part C of Form 15CA if NRI received gift from father (Resident) of Rs. 11.50 Lakhs ?

12 August 2025 Key points:
Gifts from relatives (which includes father to son) are exempt from tax under Section 56(2)(x) of Income Tax Act.

No tax liability arises on such gifts, and consequently, no TDS is required.

As per CBDT rules, Form 15CA Part C is required only when TDS is deductible on the payment.

Since gift from father is exempt and no TDS is applicable, filing of Form 15CA (Part C) is NOT required.

However, Form 15CB (Chartered Accountant Certificate) is also not required in this case.
