Forger signature on memorandum

as per sec.35 certificate of incorporation once issued cannot be challenged in any court or tribunal on any ground whatsoever. even where the signature on memorandum Is forged. but is there any penalty or punishment regarding this. If yes then pls explain

Section 35 of companies act 1956 is no more in force now. Please check.

So which new section relating to the above query

No provision exist in Companies Act 2013 in place of Section 35 of Companies Act 1956.
