05 December 2012 Sorry Gentleman , I am more clarifying about the matter that , the service provider party does not own any PE in Taxable Territory of India , and as peer explanation of Section 9 (1)(VII) of the IT Act and amended by F Act 2012.

If service provider does not have any PE in taxable Territory of India, then Service receiver is liable to deduct and pay the TDS by Grossing up the invoice.
