Filling of Service tax half yearly returns

12 April 2009 one of our claint service provider(event management ) , he is not paid the service tax at the 31.3.2009 due to more TDS deductions there money has struced because of TDS Deductions , They are training to arrenge for money but for that some time is required . now the problem is he is not paid the service tax before the filling date can we file the service tax returns (ST-3) without payment . showing outstanding tax payable in returns .

Please help me.

12 April 2009 Pay now and reflect in the return with interest.

If unable to pay, then inform department financial hardship and that you will pay with interest. to avoid SCN.

Firs check if your liability has arised , since it is stated that payment has not been received.

12 April 2009 There is space to show the unpaid liability. It shows that, return can be filed even the entire tax has not been discharged.

How ever, tax should be remitted along with interest within resonable time.

Such payments should be disclosed as arrear of revenue in the next return.
