Filing of balance sheet

Dear All,
I am attending a scrutiny case of my company. The company was incorporated on Jan-2012. But in accordance with the Companies Act, our erstwhile Auditor prepared the Balance sheet for 15 months i.e. Jan-12 to Mar-13. But we have not filed the Income tax return for Ass Yr 12-13 for year ending on 31/03/12. The AO is asking me to file the said return along with Balance sheet and pay penalty u/s 271F. I want to know that as i dont have a balance sheet as on 31/03/12 can I take the stand and just file return of income without balance sheet?
Senior members, kindly guide me on this.

no, in any cae balance sheet needs to be prepared and filed for true and correct disclosure in itr of co.
