Factory act - minimum working hours.

02 September 2011 Please help me out in regard to following query
I know that as per factory act Where a worker works in a factory for more than nine hours in any
day or for more than 48 hours in any week, he shall, in respect of over
time work, be entitled to wages at twice his ordinary rate of wages.
However, in my case, company has given some work to contractor and thereby fix rate per labour or per labour hour.Is it concern of company whether the labour working in factory premises but working for the contractor is getting overtime or not.

09 September 2011 in your case the company is not focused to maintain master roll of contract workers even. but the contractor would maintain the hours and days of the workers provided by them. so these burdens are passed on the contractors itself.
