My name is Kamal Raj i am working as an accountant in Advertising Company. My query is about Export of Service.
1. Is export of Service is taxable ?
2. Please tell us what is the defination for Export of Service.
3. Please tell us notification No. and date
We have done the editing work ( Service in office at India and Exported to Australia by DV tape. This is the transation incurred. Please tell me is service tax applicable for this type of Transation. Please note that we have received payment from Australia from the Client.
Please help me in this regards its urgent

1) Export of service is not taxable.
2) Export of service means either the servie should have been performed outside India or the usage of service should be outside India and the realisation should be in foreign currency.
3)Please see export of services under the service tax website www.servicetaxindia.gov.in.
4) If you are receiving the money from australia in foreign currency and further if the editing work what you have done wherein the final output is utilised in australia then your service is exempt from service tax.

The Foriegn company does have any base in India.
Service tax is not payable since service recipient is outside India , therefore will qualify for export of services provided payment is received in FE
