26 July 2013 Incase if the service Provider is a lawyer and the received is a company, then the liability to pay 100% service tax is of the company.

Due to this the lawyer may not put service tax in his bill. What should the company do. The Lawyer's Turnover may be less than Rs 10L than what is to be done.

Incase if the lawyer do not have service tax number also, than should the company pay 100% Service tax

26 July 2013 The liability lies with the Company for the advocate fees (bill) under reverse charge for :

a) even if the lawyer is not having RC
b) even if the lawyer's annual turnover is less than 10 lacs.
