Execution of Sales Order under EPCG

10 December 2010 We are a dealer registered with Excise Deptt. and are also registered with DGFT & have IEC.

One of our customer has placed order on us for equipments manufactured by our principals (manufacturer) under EPCG Scheme, wherein Customer will claim excise paid on equipment by our Principals.

Our query is :

1. Can we as a third party invoice the equipment supplied directly by manufacturer to customer - wherein the commercial invoice will be raised by us.

2. If yes, the EPCG License to be issued by customer will be in the name of manufacturer or in our name.

11 December 2010 1. You can raise commercial invoice as third party.

2. EPCG certificate will be issued by customer to principle manufacturer.

22 December 2010 as per foreign trade policy 2010-11, para 5.3 "EPCG scheme covers manufacturer exporter with or without supporting manufacturer (s), vendor(S) merchant exporters tied to supporting manufacturer(s) and service providers.

as per para 5.7.1 of handbook of procedures says that" EPCG AUTHORIZATION HOLDER SHALL EXPORT EITHER DIRECTLY OR THROUGH THIRD PARTY(S). IF A MERCHANT EXPORTER IS EPCG HOLDER, NAME OF SUPPORTING MANUFACTURER WILL BE INDICATED ON THE EP COPY AND OTHER COPIES DULY SIGNED BY LEO SUPTDT. OF THE SHIPPING BILLS. AT THE TIME OF EXPORT EPCG LICENCE AND DATE MUST MENTIONED ON SHIPPING BILLS FOR E.O. FULFILLMENT.
