04 November 2008 We have paid service tax in excess for particular month. whether the same can be adjusted in next month or we have to file refund claim.
Please answer in both the scenario one we have filed the half yearly return and second we have not filed half yearly return

04 November 2008 As per rule 6(4A)of Service Tax Rules,1994 the excess service tax paid to the government in a month can be adjusted against the next month's tax payment subject to the satisfaction of the conditions mentioned in sub rule 4B.
The second part of your query is not understood by me and hence it is left open.

05 November 2008 My second part of querryis:
If suppose i have paid excess service tax in the month of april and detail of bills comes in october. then these two month fall in two half yearly return. as only in october i came to know the exact liabiltiy of the april.whether i can adjust the same in the month of october.

21 July 2024 Yes, you can adjust the excess service tax paid in April against your liability for October once you have received the details of bills.
