ESIC & Provident fund

An employer has deducted ESIC and provident fund from their employees salary from april to january but could not deposit the same as still the relevant account has not been opened. only the provision has been made.
Is it rite to do so cause it is a loss to employee as the amount is been deducted from their salary but the same has not been deposited.
can someone help me regarding this issue??
