Dear sir,
my question is regarding the coverage of the establishment under ESIC act
sir,
There is one factory in GIDC area and had employed more than 20 employees in the factory.
and the client has deined the applicability of esic to the factory on the ground that there is no hospital covered by esic within 1km to 2km area or range from the factory place...
so my question is whether there is any non applicability on the above basis in the act or not??
because i tried my best to find about the reason whether the contention of the client is right or not??

Client's view doesnot override the provisions of the law.
You, as his consultant, have suggested him and if he doen't follow your advice let him face the music.

but the client said that he has seen on web site somewhere where such type of non applicability or non coverage of esic to the establishment..
so i need some other experts view on this matter

If the client thinks he knows the law then what for he is hiring you as his consultant?
You gotta be clear about the business of the client and the notification that exempts his company from the applicability.
I don't know what more to add to your situation.
