14 November 2011 RESPECTED SENIORS,

PLEASE TELL US ABOUT ER-6 RETURN ( WE HAVE 3 UNITS CONTAINING SEPARATE ECC CODE IN THE SAME NAME ) OUR QUERY IS :

WHY WE SUBMIT THE ER-4/5/6/7 RETURN WHEN OUR CENVET + PLA IS LESS THEN 1 CRORE FOR EACH UNIT.

BUT WHEN WE CALCULATE THE AMOUNT OF ALL 3 UNITS TOTAL AMOUNT OF CENVET + PLA COMES MORE THEN 1 CRORE

14 November 2011 once the agregate limit for combined all units exceed 1 cr, revenue, ER 4/5/6/7 is to be filed for each unit, as the limit is agregate for all units not for any single unit.

28 November 2011 Please note that Circular F.No. 201/20/2009-CX 6 dated the 28th May 2010:






1.Manufacturers who have paid Central Excise duty of Rs. 10 Lakh or more (including payment by utilisation of Cenvat credit) in the previous financial year shall file their Annual Financial Information Statement (ER4) as prescribed under the proviso to clause (a) of sub rule (2) of Rule 12 of the Central Excise Rules, 2002,electronically.
2.Manufacturers who have paid Central Excise duty of Rs. 10 Lakh or more (including payment by utilisation of Cenvat credit) in the previous financial year shall file the Annual Declaration relating to principal inputs (ER5) under the second proviso to sub rule (1) of Rule 9A of the CENVAT Credit Rules, 2004; and
3.Manufacturers who have paid Central Excise duty of Rs. 10 Lakh or more (including payment by utilisation of Cenvat credit) in the previous financial year shall file the Monthly Return of information relating to principal inputs (ER6) under proviso to sub-rule (3) of rule 9A, electronically.
