03 January 2011 A partnership firm cannot become a member in a company.It can be a member in a sec 25 company?? Wat is objective behind this ???

03 January 2011 Dear Friend

Section 41(2) provides that only a person can be member of a company who has agreed in writing to become a member and whose name is entered in the register of members.

As per Department’s Circular No. 4/72, dated 9-7-1972, it has been clarified that “a firm” not being a person, can not be registered as a member of a company.

Company includes, section 25 company.

04 January 2011 But i dont understand this. how can a partnership firm be a member only in a section 25 company and not in any other companies?
