Eligibility in case of death or disablement --gratuity

09 February 2014 Hi all,

pls help me to know is there any minimum length of service to be eligible to receive gratuity under the gratuity act 1972 in case of death or disablement of employee.

As far as i m concerned there is no such minimum length of service under the act as continuous service of 5 yrs service is not applicable in case of death and disablement.

please reply in reference to case law if any i haven't find any. and please also clarify that benefit payable in case of death after 2 yrs is paid as pension as in case of govt. employees is it so? If not than what is the actual benefit to be received in case of death before one yr.

09 February 2014 well section 4 is self explanatory. no need to search for case laws... no minimum period required. all other provisions of the act shall apply normally.
