27 October 2008 I have a doubt

E filing of a company has been done without digital signature.

Requirement is that we have to file with Income tax with in 15 days

What happened is that our client forget to file with in 15 days. What is the remedy available.

Do we have to file a revised incometax return for the company

27 October 2008 The returb filed by you is become void ab initio.

Now, you have to file belated return.

27 October 2008 Date of physically filing ITR V with IT department will be considered as date of filing the original return. No need to revise the return.

27 October 2008 That means the client needs to file the ITR V with Income Tax Office though it is after the due date ( I mean 15 days)

The only result is that it will be treated as belated return

No need of again uploading and so.

27 October 2008 I agree with Mr. Pawan. As the return filed is void ab initio, you have to file a revised return. The process of filing the Belated return will be the same. You will have to upload it again, but remember, in this form you will have to change the code of filing of ITR, i.e. from Retun filed within due date to Return filed after due date. Then file this ack. within 15 days with the Deptt.

27 October 2008 Either Rule 12 or Electronic filing of return scheme 2007 does not say as Tarun said.

28 October 2008 Not required to refile the return , take old return which is not having digital signature, file with i.t department physically . however it will atttract Rs.5000/- of fine
