11 September 2014 My case is Salary and Capital Gain Raised and Filed IT Return for the the A Y 2013-14 Return Filed on 30.7.2013, NON TAX AUDIT CASE But IT Department raised Notice U/S143-2 department send Notice dated on 02.09.2014.

My Query is That notice Valid or not. Because I Filed on 30.7.2013, Non TAX Audit Case Notice DATE should be Before 30.07.2014. But Department Mentioned clearly on 02.09.2014. I wen to department Due date of Notice date is 30.9.2014 for A Y 2013-14. Is correct. Please clarify this sir

11 September 2014 In your case Notice u/s 143(2)can be issued till 30/09/2014. Even in non audit case notice can be issued. The notice issued by dept is valid.

12 September 2014 financial year following assessment year is used to calculate whether u t under AO's jurisdiction.

u made a mistake u went and appeared before him .sees u did not consult either PRO of tax dept or CA or tax lawyer.

Once you appear before him u subject yourself to his jurisdiction, even if you do not fall under his jurisdiction.once u appear u give a waiver on him!
always have a proper consultation. else y get into noose in his hands!
