22 July 2009 hi all
just have a ques.
(1)a person(r), earned some part of his salary in india & some part of salary in usa

(2) a person(nr), earned some part of his salary in india & some part of salary in usa

ALL OTHER CONDITIONS ARE SAME

Q. Is there is same tax treatment in both the cases or different & what is it?

22 July 2009 Taxability of income of a resident is different than a Non-resident.

Entire income of a resident from whatever source is taxable in his/her hand in India.

Non-resident income which he/she has earned from India can only be taxed in India.

22 July 2009 thanks for the reply abhishek.

but what about DOUBLE TAXATION AVOIDENCE AGREEMENT with USA
