Director providing professional services to the company

18 March 2017 A director of a company is providing taxable service to his company, under RCM company is liable to pay Service tax thereon. I wanted to know whether this Director is liable to get registered under Service tax as company has already paid him 750000/-

18 March 2017 No, director is not required to register under service tax because he is not liable to pay service at all for the services provided to company, and As you have also mention company has to pay service tax under reverse charge.

18 March 2017 Thanks Mr. Shubhanshu, services provided by a director to the company comes under RCM that is the reason why i had mentioned that company has to pay service tax, but my query is this director will cross the limit of Rs. 10,00,000/- now is he liable for registration or not.

18 March 2017 No, is that also director is not liable for registration because he is not at all liable for payment of service tax. When person is not liable for payment of service tax he is also not required to get himself registered under service tax.
