if the din-4 is not submitted within the due date then what are its penal provisions? and what are its remedies?

Non-provision of PAN details or any mismatch in DIN and PAN information will be treated as
default and such DIN's may be disabled for access of MCA21 System.

However, the date of filing of DIN-4 is extended up to 30/04/2012 vide MCA General Circular 4/2012.

should NRI directors who are non executive need to apply for PAN and submit DIN4? is there any exemption for NRI directors?

But if the director is a foreign national,the issue is vexed in view of the observation in
