13 December 2009 What is the difference between decree & order.

Explain the abovemetioned query & belowmwntioned query with the examples please.

Meaning Of decree :
1. A legally binding command or decision entered on the court record (as if issued by a court or judge

WHat do u mean by on the court record .

Exaplin me please .

14 December 2009 The Code of Civil Procedure,1908 defines Decree as formal expression of adjudication while Order means any decision of a Civil court. [refer section 2(2) and 2(14)]

In simple, decree is a final settlement of a claim which comes on a plaint. While order does not settle a claim/right and may be passed during the course of pendency of plaint and may be on any application.
