Credit of tax paid.

06 August 2012 On advocates service now service recepient is required to pay service tax under reverse charge , can anyone tell me if service provider is not registered with service tax deppt, and he is providing advocates service, how can i avail cenvat of s. tax paid on advocated service, and is their is mandatory to give service provider service tax no. while filing service tax returnso that i can take credit?

06 August 2012 If service receiver is not in the bracket of service tax, he/she needs not pay the same to service provider nor pay by himself/herself.

06 August 2012 But company is receiving advocate service, now, as per new notification, company has to pay 100 % service tax, now if advocates dont have service tax number, can we take creditof service tax paid under reverse charge mechanism ? I read in partial reverse charge where service provider being ssi, claiming exemption of Rs. 9 laks, dont have to get register himself, we can take credit in that case on the basis of challan.
