17 June 2009 define the difference between charge and mortgage.
how will create charge over the assets of the listed company
also pls describe necessary documentation with ROC & others

When you take loan against the security of immovable property then it is in the nature of Mortgage.

If you borrow from any bank against the security then you have to file form-8 for creation of charge with in 30 days of creation as per section 125 of companies act, 1956.

17 June 2009 If you the list of compulsorily registerable charges then refer Section 125(4) of Companies Act, 1956.

17 June 2009 Only one change to the above answers that "Charge is to be registered within 30 days "after" the date of execution of charge agreement.

19 June 2009 and if u fail to get the charge registered in first 30 days then there is another 30 days available with late filing fee.
