Dear Experts,
I have three query as under.....
1) can a composition dealer sale the goods to composition dealer,
2) we have send the goods by delivery challan with eway bill but buyers has denied to accept the delivery there. Pls let me how to return the goods now. .and what will happen of eway bill. Will I have to generate new eway bill.
3) a company is supply us the goods in combo pack at 5% may be composite supply, can we sold the goods in break I.e. all separate goods at applicable tax rate, is it allowable...

You can sale good to any body and everybody including composite supplier , but you can not charge GST .
Yes , you have to generate new e way bill indicating movement from your buyer's place to your place .
Yes , you can sale the goods in break . You are not going to get ITC on items purchased and your sale will be inclusive of Taxes

My issue is query 2, pertain to sale by composition dealer to composition dealer. In general parlance a composition has to pay tax FROM both side first he cannot claim ITC of paid tax purpose also 1% on sale. Hence it the composition dealer will purchase from a composition dealer therefore it is the loss of govt. Also this issue may be contrary

No loss to Government . Composition dealer will pay 1% tax to Government on turnover
