Claiming tds refund in itr filed as per new name

16 September 2018 One of the female assessee had FD account jointly held with her mother. Mother passed away and since form 15H wasnt submitted, tds was deducted by the bank. Now the assessee wants to claim the TDs refund by filing ITR but she has got a new PAN after getting married and ADHAR too. FD was held in the old name (old PAN having father's surname). Can she surrender the old PAN and file ITR with new PAN and yet claim the refund of tds?

16 September 2018 She has to be apply for legal heir certificate & file her mother return on his PAn & claim refund.

16 September 2018 Why you have applied new PAN, you would have retained old PAN wit name correction, TDS deducted old PAN Number Cannot be transferred to New PAN, It's offence to Apply N pan when you have already have PAN, Any changes you can get to old PAN number. the duplicate PAN card holders are found to be using these cards for fraudulent purposes, they will be fined Rs 10,000 under Sec 272 (b)

Better You surrender New PAN, file in OLD PAN, you can get corrections of Name by submitting Gazetted Officer Letter and get PAN CORRECTION
