Civil work -reverse charges

05 September 2012 Dear Expert,

We do Industrial construction work .For execution civil work we enganged technical person to caary out soil anatical testing,engineering etc, he charged 12.36% ser tax. Under reverse charge shoule we have to pay 50% Service tax, & can we take 100% Service tax credit paid to him, We opt for composition scheme.

05 September 2012 The Works Contract (Composition Scheme for Payment of Service Tax) Rules, 2007 has since been withdrawn vide notification 35/2012 w.e.f. 01.07.2012.

The soil analysis service is not a works contract service and hence not a subject of RCM.
