CENVAT credit

This query is : Resolved

21 October 2010 Dear Friends,

information: Service tax paid on electrical fittings, installations, and labor work for construction.

Query: Whether such service tax can be availed as capital goods (50%+50%) or input service (100%).

Query: Construction work done in previous year, no service tax availed at that time, whether allow to avail now (by 100% or 50%+50%)?

Guide with section, case or other.

Regards,
CA Ankit Shah,

And Thanks if reply.

21 October 2010 capital goods maens goods falling under chapter 82,84,85,90,6805 of the first schedule of central excise act.

If it comes under the above chapter, you can take 100% credit in this year.

As per law, in the year of recipt credit can be taken to the extent of 50%. since you have taken 0%, subsequent year you can take balance portion i.e. 100%.

23 October 2010 i think CA Shailesh Kumar Bhagat is right...
