Capital gain on transfer of immovable property by nri

This query is : Resolved

01 March 2013 Mr. X is a non resident Indian. He sells an immovable property in India. What will be the tax treatment ? Whether he will get the benefit of indexation ? And if he is eligible for the benefit of indexation, then whether LTCG will be charged at:

1. 10 % without indexation
2. 20% with indexation.

Please advice. Its urgent.
Thanking You

01 March 2013 the option of 10 % without indexation or 20 % with indexation is not available in case of sale of immovable property but available only in case of shares & securities. But whether the benefit of indexation is available to NRI in case of transfer of immovable property as the rate of tax is 20 %.

01 March 2013 Please experts do advice me.

16 August 2023 Yes, available.
