leave encashment

As person has taken applied for leave encashment in the month of March-08, but has got sanctioned in the month of April-08 and payment was also disbursed in the April-08.

Now my question is that -

Whether it should be booked as liability in the month of March-08 by booking as expense for march-08, or it should be booked in the month of April-08 as expense.

If it booked it in the month of march-08, whether company is liable to deduct tax in the month of march-08 itself.

and finally, when it will be taxable in the hand of employee, in the previous year 2007-08, or in the previous year 2008-09

Most probably not. There is a slightchance that you are allowed to leave the firm:

a)if u r a dummy article
b) ur CA is very ethically minded abt following ICAI rules sincerely
c) u r working under ur dad/mom/relative's firm.

Students in the above category are not even 10pc of the total article students. the ICAI has made it a rule that ARTICLESHIP HRS SHOULD BEGIN B4 11AM AND NOT EXCEED 5PM.
But which CA cares about the ICAI rules/ Rules are meant to be broken: Members from ICAI chapters or city offices do so to their articles: the remaining CAs are bound to be even inconsiderate. I can bet not even 5pc of the practising CAs have begun adhering to this rule of articleship hours.

ICAI is impotent in enforcing this coz its top members are not interested in it. There are few practioners and lots of eagerly expecting articles. After passing CPT; it is really tough to secure an articleship.

So, the students can't even ask their CA ABT THE RECENT CHANGES IN icai WORKING HOURS. If they try to; then they are in deep trouble. CAs are influential people. The poor student may not lose many days in getting his transfer in article: and thrugh his previous MIT's ifluence; he may lose even more time in getting another worthy MIT.

Now, u may say "why don't students' complain"? I will say " the whole thing is that bhaiyya, sabse bada rupaiya"? Students don't want to jeopardise their chance of being financially sound after being CA(they have to have to face 3.5 yrs of rigorous aticlesip) and CAs are better left unchalleneged. My CA has not cared a da** abt this new rule. Plz tell me what is happening in ur case.

Cenvat Credit

Respected Dear Sir(s),

We hv following query. We request your Valuable review on this.

The assessee is paying service tax on goods transportation by road freight....as a service receipient.

The assessee has availed credit of ST paid by it on Advertisement Exp. and have utilised the same for paying service tax on freight, payable by it as a receipient of service.

The assessee has done so upto 1st March, 2008, under bona fide assumption that, it is a "deemed service provider" and therefore can take credit and utilise the same for payment of service tax on frieght.

Sir, Will u please guide us as to
1. Whether such a credit can be availed and utilised by the Service Receiptient for Payment of Service Tax on Freight ?
2. Which are the sections/provisions/rules under which the assessee is eligible OR not eligible to availe and utilise such credit ?

I AM 26 YEARS OLD HAVING 4.5 YR EXPERIENCE IN ACCCOUNT DIVISION OF 3 FINANCE COMPANIES.

MY PROFILE IS AS FOLLOE:

Ø Processing Salaries for the Regional staff i.e. Permanent & Temporary both.
Ø Cost Centre Accounting (CCA): Organization, Customizing and Maintenance.
Ø Preparation of accounting schedules required for accounts finalization.
Ø Preparing Bank Reconciliations Statement on daily basis.
Ø Payment & Reconciliation of ESI & Professional tax liabilities.
Ø Processing & Reconciliation of Petty Cash Account for the Entire region.
Ø Preparation of MIS reports to provide feedback to top management on financial performance.
Ø Preparation of P & L for Salary & Expenses.
Ø To keep watch on bank inflow & outflow, & accordingly make projection for next day.
Ø Verifying, Processing, & recording Travel advance requests, Employee claims, Payment requisitions.
Ø Expenses booking of all the Branches for the Entire region.
Ø Recording of routine accounting transactions in the accounting system, such as Cash, Bank & journals etc.
Ø Tracking the total outstanding of the company on a daily basis.
Ø Maintaining and monitoring of Fixed Assets Register.
Ø Looking after Full & final settlements of employee.

exemption limit

Is the basic exemption limit of Rs 10.00 lakhs applicable each year? ( like IT)
Or liability to service tax arises as soon as limit of 10.00 lakhs is exceeded in each year ? Suppose an assessee has 5 lakhs,7lakhs,10 lakhs as billed services during last 3 yrs how the service tax provisions would apply
