Capital gains

Dear friends,

I'll put forth my doubt here.Sec. 54 of IT Act is applicable w.r.t sale of a residential property and investment in another residential property.What will be the consequence if a person owning 3 flats with separate door nos. (within the same compound) sells all of them and invests in a single residential property.Also explain the wealth tax perspective of this transaction.

Sec 40A(3)

As per the provisions of Sec. 40A(3) if the payments were made by otherwise then account payee cheques / bank draft are disallowed.

1. Wheateher purchases also covered?

2. if some one has deposited cash in Creditors account through core banking system, wheather it is to be disallowed as per provision of Sec. 40A(3)?

best judgement assesment

As per Sec145(3) on Income Tax Act, if AO is not satisfied about the correctness or completeness of the accounts of the assessee, or where the method of accounting provided in sub-section (1) or accounting standards as notified under sub-section (2), have not been regularly followed by the assessee, the Assessing Officer may make an assessment in the MANNER provided in section 144. Is this means that in this case only best judgement assesment under Sec 144 will be done? In other words can best judgement assesment be done in cases other than specified in sec144?
Q2.Can refund be granted u/s 144. If yes, in what conditions?

Related to saletax and excise duty

I want to purchase some kahdi gram udyog item from jharkhand and I am residing at haryana.

During enquiry with dealer, he said that this item is exempt under the sale tax law of jharkhand, and we are dealing exclusively only in this item, so sale tax registration is not complusory, and without registration of sale tax, we are eligible to supply good to you at haryana.

Here my question is that whether he is eligible for supply of good to me without having any sale tax number.


Now, at haryana, after receving this item, I will repack it and put my company name and supply to a reconised export house for export against form H at hydrabad (A.P).

Here, my question is that whether I required to get sale tax number to supply this item.

and second question is that whether I am liable for excise duty as I am doing rebranding of the product.

Branch account

Dear Sir/Madam

Please tell me

We are the Branch office at Mumbai and HO is at Delhi. and in tally if I want to create my company account Head office name will be Branch Acccount or My company will be branch account. In tally I have checked, In creation of our company nothing is aksed for branch.

Please tell me what to do.

Post Dated Cheque paid by the Bank

Dear all,

I need your valuable openion of the following issue:

I had issued two cheques to a party one of them was post dated cheque (Due in July 08). However, the party first presented the post date cheque to the bank and bank processed it by debiting my account but due to this my second cheque, which was a valid cheque, got Dishonoured on account of insufficient balance in my account.

Kindly suggest me what kind of action I can take against the bank as the cheque bouncing is matter of Negative Credit Rating.

Please reply me ASAP
